Back in 2009, a company called IPCom, owner of a number of standard-essential telecommunications patents, has filed suit against Taiwanese manufacturer HTC for alleged infringement of a patent on UMTS 3G technology.
IPCom was at that time granted the injunction of sales for HTC devices but HTC has appealed the decision which of course suspended its execution. The appeal was set for November 28 but HTC withdrew the case from the appeal, making the initial ruling come into effect immediately. “HTC considers that the appeal had become redundant as the German Federal Patents Court had previously held the relevant claim of the patent to be invalid.”
The situation becomes a bit more complicated with that certain HTC move as IPCom’s ban request can immediately go into force. HTC will either stop selling devices in Germany of pay of to license the patent infringed upon.
