Apple Seeks Preliminary Injunction Against Samsung Galaxy Nexus
Apple is looking to score a preliminary injunction against the Samsung-made Google Galaxy Nexus, the flagship “pure Android” and the icon of the Ice Cream Sandwich iteration of the platform. Apple brought four “high-power patents” (characterized by Florian Mueller as “Four Horsemen of the Apocalypse”) as ammunition against Samsung.
It appears that only one patent would be sufficient to grant the injunction: the “data tapping” patent based on which the ITC imposed an import ban against HTC. Apple wants to win this one as it brought three more aces to the table: 1. a patent related to Siri and unified search; 2. a new slide-to-unlock patent; 3. a word completion patent that provides major speed improvements for touchscreen text entry.
Apple filed the request with the United States District Court for the Northern District of California and against the current “pure Android”. This means that if the injunction is granted, it is Google’s sole responsibility as the Galaxy Nexus doesn’t contain any customizations or other manufacturer-specific enhancements.
“Theoretically, Google could remove the functionality protected by any of these patents in order to keep the product on sale, but if it changes the program code of a lead device, this would make it particularly clear to everyone else in the market that there’s an infringement issue“, said Florian Mueller.
