Judge Dismisses Motorola 3G Patent Lawsuit Against Apple

Motorola recently won an injunction in Germany against Apple’s iCloud (and the predecessor, MobileMe), but it appears that the case involving an essential patent to the 3G/UMTS wireless telecommunications standard has been dismissed by the Mannheim Regional Court.

Judge Andreas Voss declared that Motorola Mobility failed to present enough evidence for an infringement and as such, declared that Apple is not infringing the claimed patent related to “a method and system for generating a complex pseudonoise sequence for processing a code division multiple access signal”. According to Florian Mueller, Motorola Mobility “argued that any implementation of 3G/UMTS must inevitably infringe this patent claim”; however, Motorola failed to prove any implementation whatsoever, hardware or software.
